HOMELIFE "$10,000" Sweepstakes
No purchase is necessary.

Eligibility

The Homelife Realty Services Inc.(Sponsor) "$10,000" Sweepstakes is open to all legal residents of Canada, excluding the Province of Quebec, who have reached the age of majority in the province in which they reside on or before the Contest Closing Date. The sweepstakes commences on or around December 1, 2004. To be eligible, all entries must be received by 11:59:59 P.M. EST (Eastern Standard Time) December 31, 2005 (the "Contest Closing Date").

Officers, directors, representatives and employees of the Sponsor, its parent, affiliates, or subsidiaries, their advertising, promotional, publicity, production or judging agencies, and all those living in the same household as the above individuals, are not eligible to enter.

How to Enter

  1. Obtain and complete an original Homelife Realty CONTEST NAME entry form, from participating dealers throughout Canada, by printing your name, address, telephone number and age. Mail the entry form, in an envelope bearing sufficient postage, to:

  2. Visit the sweepstakes website at www.homelife.com, complete the online entry form by providing your name, address, email address, telephone number, age, and confirm compliance with the contest rules and submit your entry online to be automatically entered in the contest. In the event of a dispute regarding submission of an online entry, the entry will be deemed submitted by the authorized holder of the e-mail account. The authorized account holder is the individual who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address.

There is a limit of one entry per household or per e-mail address (regardless of method of entry). One contest entry per envelope. If a consumer submits more than the allowable number of entries, all of that consumer's entries will be disqualified. All entries become the property of the Sponsor and shall not be returned. Entries generated by a script, macro or other automated means are void. Entries that contain typographical errors, are altered, tampered with, incomplete, inaccurate, irregular in any way, or otherwise not in compliance with the Official Rules and Regulations, are also void. Proof of sending not deemed to be proof of receipt.

All submitted material will become the property of the Sponsor and none will be acknowledged or returned. The selected entrant(s) will be notified by mail, e-mail or telephone. Entries are subject to verification and will be declared invalid if they are altered or tampered with in any way.

Draw

On the fifth business day of each month (starting January 7, 2005 and ending January 7, 2006), during the sweepstakes period, an independent judging organization will randomly select ten percent of the entries received, during the previous month. Those randomly selected entries will then be eligible for a final random draw, on January 14, 2006 (the "Grand Prize Draw Date"), at 661 Millidge Avenue, Saint-John, New-Brunswick, at or around 8:30 a.m. AST. The odds of being selected in any given month to qualify for the Grand Prize draw are 1 in 10. The odds of being selected in the Grand Prize draw depend on the total number of entries received.

The judging will be conducted by an independent judging organization whose decisions on all aspects of this contest shall be deemed as final and binding in all respects. By entering, participants agree to be bound by the contest rules and regulations and the decisions of the independent judging organization. This contest is subject to all applicable federal, provincial and municipal laws.

Prizes

Prize must be accepted as awarded. No substitution, transfers or refunds will be allowed. However, Sponsor reserves the right to substitute a prize of equal or greater value in Sponsor's sole discretion. Arrangements will be made for the prizes to be delivered to the confirmed winners' place of residence.

Grand Prize

There is one (1) Grand Prize available to be won, consisting of $10,000 (CDN) in cash. Retail value is $10,000.

In order to claim a prize and be declared a winner, the selected entrant will be required to:

  1. correctly answer, without assistance of any kind, the mathematical skill-testing question to be administered by mail or telephone at a pre-arranged mutually convenient time.
  2. complete and sign a declaration and release statement, in order to; confirm compliance with the rules and regulations, accept the prize as awarded, without substitution, release the Sponsor and its affiliated companies from any liability, as described more fully below, and consent to the use of his or her name, address (city and province), photograph, and likeness, as described more fully below.

Failure by any selected entrant to complete, sign and return any of the aforementioned documents within 14 business days after notification is sent to the address on the selected entrant's entry, or the return of prize documents as undeliverable, may result in forfeiture of the prize and selection of an alternate winner in the sole discretion of the Sponsor. If a selected entrant cannot be contacted in a timely fashion, or if for any other reason the prize cannot be awarded, another contest entry will be randomly selected by draw until the prize has been awarded. Failure to correctly answer the skill testing question will result in disqualification, the forfeiture of his or her interest in the prize, and the random selection of a substitute winner from among all remaining eligible entries. Communication will be entered into only with selected entrants.

Personal Information

The entrant may consent to the Sponsors' collection, use and disclosure of his personal information to any third party for consumer research, marketing and contest-administration purposes by selecting the option on the mail-in or online entry form as stated below:

"You have my permission to collect, use and disclose my personal information to any third party for the purposes of consumer research and marketing."

The entrant may consent to the occasional receipt of product-related information from the Sponsors, for the purpose of notifying contest entrants of new products and obtaining customer feedback by selecting the option on the mail-in or online entry form as stated below:

"You may keep me up-to-date and obtain feedback from me on such things as new product releases and upcoming promotional events."

No Responsibility

The Sponsor assumes no responsibility for:

  1. lost, delayed, destroyed, misidentified or misdirected entries, or entries deemed irregular by the contest Sponsor in its sole discretion, which are automatically void;
  2. incorrect or inaccurate capture of entry information, technical malfunctions, human or technical errors, printing errors, lost, delayed or garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer line or network, computer equipment, software or any combination thereof, whether originating from sender or recipient; and
  3. any problems, errors or negligence that may arise or occur in connection with the contest including but not limited to any damage to an entrant's computer equipment, computer system, software or any combination thereof, as a result of the entrant's participation in this contest.

Right to Cancel

The Sponsor reserves the right to cancel or modify this contest if, in its sole discretion, it determines that for any reason this contest is not capable of running as originally planned, or if fraud or any other occurrence compromises the fairness or integrity of this contest. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole discretion, to cancel or suspend the Internet portion of this contest should a virus, bug or any other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of this contest.

Criminal Prosecution

Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

General Release and Indemnity

By entering this contest, entrants agree to release and indemnify and hold harmless the Sponsor and its parent and affiliates, subsidiaries, advertising and promotional agencies, and their respective directors, officers, employees and agents, from any claim, loss, expense (including legal fees) or other liability which may be sustained in connection with the contest, including, without limitation, any damages resulting from the receipt, ownership or use or misuse of a Prize, or while preparing for, participating in, and/or travelling to any prize-related activity.

No Warranties

The Sponsor shall not be liable to the winner of any prize for any guarantee, warranty, condition or representation, express or implied, relating to the prize, including, without limitation, its quality, condition or fitness for a particular purpose.

Publicity Release

By entering this contest, entrants consent to the use of their name, age, address, photograph, likeness in any publicity related to this contest carried out by the Sponsors, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, unless prohibited by law.
